Information notice for the processing of personal data operated within the framework of the BNE platform network attached to the bne.lu website

The www.bne.lu website offers its members an exchange network called the «BNE Platform» on the subject of sustainable development. This network has been in existence since 2009, and is managed by the French Ministry for the Environment, Climate and Biodiversity (hereinafter «MECB»). As part of the management of registrations in the Platform's list of network members, the MECB processes your personal data (hereinafter «your data») in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC - in short «General Data Protection Regulation» or «GDPR».

2. Lawfulness and purposes of processing and categories of data processed

The legal basis

The legal basis for processing your data is your consent.

Without prejudice to the application of other lawfulness bases, MECB carries out the data processing for which you have given your consent. Please note that you have the right to withdraw your consent at any time (without prejudice to the lawfulness of the processing based on the consent given prior to the withdrawal of consent). To exercise your right to withdraw your consent, please contact our Data Protection Officer, specifying the processing for which you wish to withdraw your consent.

Categories of data processed

The MECB processes the following categories of data:

* your first and last name,

* your e-mail address,

* your place of work (optional).

Processing purposes

The purposes for which your data is processed are as follows:

* network member management,

* the monthly newsletter for the BNE platform network,

* invitations to meetings of the platform, thematic working group(s) and other events organized by the committee.

3. Data recipients

The recipients of your data are: the administrators of the bne.lu platform/website, including staff from the MECB and in particular the Climate, Sustainable Development and Circular Economy Department and the Communications Department.

The e-mail used to send Newsletters contains only the recipient's address. All exchanges between recipients are made via the network managers. N.B. Network managers will publish your requests and communications to the group at your request.

In the particular case of the organization of voluntary thematic working groups on the platform, your contact data will be visible to other platform members of this working group to enable an exchange.

4. Collection of data from the data subject: optional nature of data provision and consequences of refusal to provide data

The provision of your data is optional. If you refuse to provide us with the requested data, you will not be able to receive the newsletter or take part in the activities of the BNE platform network.

5. Shelf life

Your personal data will be kept in a form that allows you to be identified for the maximum periods set out below:

* For the time necessary to achieve the purposes of the processing, and

* One month after your deletion request. If an incorrect or inactive e-mail address is detected, your data will also be deleted within one month of detection.

The above retention periods apply without prejudice to any further processing for compatible purposes, in particular for statistical or scientific research purposes, or for archival purposes in the public interest (in particular their deposit and preservation by the National Archives) or for the purposes of ongoing legal proceedings.

6. Transferring your data to a third country

Your data will not be transferred outside the European Economic Area.

7. Your rights

You have the rights provided for by the provisions of Chapter III (Articles 12 to 22) of the RGPD. You may thus, within the limits of the applicable legislation, access data concerning you and obtain a copy thereof (Article 15), obtain the rectification of inaccurate or incomplete data (Article 16) and obtain the deletion thereof under the conditions set out in Article 17 of the said regulation.

You also have, within the limits of the applicable legislation, the right to object to the processing of your data under the conditions set out in Article 21 of the RGPD.

In certain cases, you also have the right to limit the processing of your data (article 18) and to portability (article 20). The processing of your data does not involve any automated decision producing legal effects concerning you or significantly affecting you in a similar way.

Any communication relating to a request for information, concerning a complaint or as to the exercise of your rights under the provisions of the RGPD should be addressed to the MECB Data Protection Officer.

8. Complaint to the National Commission for Data Protection (CNPD)

If, after having contacted us, you believe that the processing of your data carried out by MECB constitutes a breach of the GDPR or that your rights under the said Regulation have not been respected, you may lodge a complaint with a data protection supervisory authority, namely in Luxembourg the Commission nationale pour la protection des données (https://cnpd.public.lu; 15, boulevard du Jazz, L-4370 Belvaux; Tel.: (+352) 26 10 60-1).
