Information notice for the processing of personal data in connection with the creation of an actor's account on the bne.lu website
Le site www.bne.lu offers players a platform for exchange on the subject of education for sustainable development.
As part of the management of registrations on this site, the Ministère de l'Environnement, du Climat et de la Biodiversité (hereinafter referred to as « the MECB »in collaboration with Service de coordination de la recherche et de l'innovation pédagogiques et technologiques (hereinafter referred to as the «Service")« SCRIPT ») of the French Ministry of Education, Youth and Children (hereinafter «the Ministry").« MENJE », together « ministries ») process your personal data (hereinafter referred to as «personal data").« your data ») in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC - in short « General Data Protection Regulation »or « RGPD ».

2. Lawfulness and purposes of processing and categories of data processed
The legal basis
The legal basis for processing your data is your consent.
| Without prejudice to the application of other lawfulness bases, the Ministries carry out the data processing for which you have given your consent. Please note that you have the right to withdraw your consent at any time (without this affecting the lawfulness of the processing based on consent carried out prior to the withdrawal of consent). To exercise your right to withdraw your consent, please contact the Data Protection Officers, specifying the processing for which you wish to withdraw your consent. |
Categories of data processed
Ministries process the following categories of data:
- your first and last name,
- your contact details (e-mail address, telephone number, etc.),
- a description of the company and its offerings, with contact details for your own staff, if applicable.
Processing purposes
The purposes for which your data is processed are as follows:
- signing the BNE charter,
- publication of your player data and offers on the bne.lu website,
- managing your «actor» account on the bne.lu website.
3. Data recipients
Recipients of your data are :
- the general public for player and offer data intended for publication; ;
- the platform administrators, including staff from the MECB, in particular the Climate, Sustainable Development and Circular Economy Department and the Communications Department, as well as the MENJE, in particular the SCRIPT; ;
- players are responsible for managing and updating their data; they alone choose the data they enter in their account, which are saved as drafts and published on the site; ;
- the management committee/directors reserve the right to withdraw published data.
4. Collection of data from the data subject: optional nature of data provision and consequences of refusal to provide data
Providing your data is optional.
A refusal on your part to provide us with the requested data will result in the impossibility of obtaining an «actor» account, implying the impossibility of registering as an actor and publishing your data and offers on the site.
5. Shelf life
Your personal data will be kept in a form that allows you to be identified for the following maximum periods:
- The actor may withdraw his data from publication at any time; the data will be deleted no later than one month after your request for deletion.
- Your data will be stored for the time necessary to achieve the purposes of the processing, i.e. the publication of your player data and offers.
The above retention periods apply without prejudice to any further processing for compatible purposes, in particular for statistical or scientific research purposes, or for archival purposes in the public interest (in particular their deposit and preservation by the National Archives) or for the purposes of ongoing legal proceedings.
6. Transferring your data to a third country
Your data will not be transferred outside the European Economic Area.
7. Your rights
You have the rights provided by the provisions of Chapter III (Articles 12 to 22) of the RGPD. You may thus, within the limits of the applicable legislation, access data concerning you and obtain a copy thereof (Article 15), obtain the rectification of inaccurate or incomplete data (Article 16) and obtain the erasure thereof under the conditions set out in Article 17 of the said regulation.
You also have, within the limits of applicable legislation, the right to right to object to the processing of your data under the conditions set out in Article 21 of the RGPD.
In certain cases, you also have the right to limit the processing of your data (article 18) and to portability (article 20). The processing of your data does not involve any automated decision producing legal effects concerning you or significantly affecting you in a similar way.
Any communication relating to a request for information, concerning a complaint or regarding the exercise of your rights under the provisions of the RGPD should be addressed to. data protection officers departments.
8. Complaint to the National Commission for Data Protection (CNPD)
If, after contacting us, you believe that the processing of your data carried out by the Ministries constitutes a breach of the GDPR or that your rights under the said Regulation are not being respected, you may lodge a complaint with a data protection supervisory authority, namely in Luxembourg the Commission nationale pour la protection des données (https://cnpd.public.lu ; 15, boulevard du Jazz, L-4370 Belvaux; Tel.: (+352) 26 10 60-1).
